    Default Can the Police Get Copies of My Prescriptions from My Pharmacy

    My question involves criminal law for the state of: Florida

    Do cops need a warrant to get copies of my prescriptions from the pharmacy?

    I would guess that a pharmacy would not hand over that kind of information without a warrant. It is part of your medical records.

    More in order of a Subpeona, and yes, they would need one.

    My son let someone use his name on a prescription of roxies. This person filled the prescription. Months later he is arrested for dr. shopping. Cops have copies of all his prescriptions they got from various pharmacies. Worried that my stupid kid is going to be mixed up in this mess as well as how the cops are able to get all the prescriptions with the Hippa law.

    Ah, there is the difference.

    They are not going to be pulling your son's records as such...they are following the trail of any prescription bottles in the possession of a suspect. VAST difference.

    Yes, they can ask the pharmacist if this is a legitimate prescription.

    For what it is worth, your son is already "mixed up" in this mess to a felony level. Selling prescriptions is illegal... VERY illegal.
