    Default Can My Neighbor Take Down My Fence Because They Feel It is on Their Property

    My question involves real estate located in the State of: Indiana

    I moved into a new house in Indiana and wanted to put up a fence right away. We contacted the HOA, and they recommended we attach our fence to our neighbor's fence. We spoke with our neighbor twice and even walked them around the property to show them exactly where the fence was to be place. They approved the fence verbally. The HOA also spoke with my neighbor prior to giving us approval to construct the fence.

    A few days after we completed the fence, I receive a letter from an attorney stating if we do not remove the fence in 7 days, they will consider the structure abandoned and remove it.

    Can they remove the fence? We did not put up a fence on the property live, just connected to their fence on the line. They do not have a survey showing the exact property line.

    I am working on getting a survey, but cannot have one complete in a few days.

    Can they remove the fence? Do they need a court order to remove the fence?

    Have you attempted to talk to the neighbor about why they changed their mind? Why they didn't discuss it with you?

    I would also recommend talking to the HOA as well since they were in on the whole thing. They may be able to provide you information.

    I'm surprised that an attorney would threaten removal after only seven days. That is clearly unreasonable. It does not allow you to get a survey, see the results, discuss them with the neighbor, and remove the section of fence on the neighbor's property, if any.

    The HOA only approved your neighbor's verbal permission for location, which could be (and was) revoked at any time. It is now likely out of the picture until some new fence is contemplated.
