My question involves a roommate in the State of: New York
I signed a year lease with a friend which she signed a roommate agreement to rent out the third room. My name wasnt on the roommate agreement at all. When my friend decided to move out she signed over all rights to the apartment. Im the sole leaseholder and now stuck with the roommate with no binding agreement. I want her to move with a 30 day notice and a full refund of her deposit. She stands that she wont move and she has rights. Ive never signed anything with her. Its my apartment and dont wish her to live with me any longer.
I spoke to management and they said Im the leaseholder nobody else but me has rights to the apt. Any guest or roommates that you have you will have to deal directly. Can I give her a written 30 day notice even if we didnt have an agreement in the first place? What are my rights?
