Default Assault and Battery Charge after More than a Decade
I got a letter today that stated that I had a warrent for my arrest for an assult and battery that happened in Sept 1993. in Michigan. The letter stated that the warrent was issued in 9/93, but I was never served with anything, also I had my license ran during small routine traffic stops, and was never informed that this warrent was issued. I cannot remember exactly what happened in this alteration, it was twelve years ago, so I cannot even really defend myself. I am supposed to show up at the Police Department with one hundred dollars bond money next Monday. Can they bring up something that happened this long ago, it is not as if I have been running from the law or anything, please advise me...thanks...B

I suggest that you contact a lawyer about your situation. The lawyer should be able to get a copy of the police report from the incident, and may be able to find out if the prosecutor's office would be willing to give a favorable deal giving the passage of time. Also, the lawyer may be able to formulate a defense based upon the delay in prosecution - even if a warrant was issued so as to avoid direct application of the statute of limitations, that delay is exceptionally long, and you are correct that normally a warrant should have been detected on numerous occasions as you underwent routine traffic stops.
