    Default Pregnant Wife from Another Man in Florida

    My question involves paternity law for the State of: Florida

    What is the Florida law regarding a woman becoming pregnant while married to another man? Is it the same thing that the husband is financially responsible for the child?

    My ex-husband and I were married while and during seperation I got pregnant. Neither guy ever signed the birth certificate. Ex-husband is now deceased. I need to claim SSI benefits for the children. (twin)

    I get that you want to take care of your kids, but why would claim something from a man that you know is not the father of your children? Why not seek out suport from the children's actual father?

    Because legally, if the children were presumed to be "of the marriage", they're entitled to benefits..and it may be far too late to disestablish her husband's paternity now anyway.

    (Which would be necessary in order for Mom to get child support from actual bioDad).

    Now...is this the "right" thing to do? Eh, who knows. I know my feelings on the subject, but the law is the law. If Dad was legally Dad, Mom can obtain dependent benefits for the kids.
