My question involves criminal law for the state of: Iowa.
My nephew was assulted today at school by a teacher. While standing in line for lunch, a fight broke out about 20 feet from where he was. As other kids were trying to get out of the way, he stumbled and fell to the floor. When he got to his feet, a teacher grabbed him by the throat leaving bruises and scratches, and shoved him against the wall. When he asked what he had done, the teacher grabbed him by the throat again and drug him to the office. The school notified his mother and I. The school placed the teacher on administrative leave pending further investigation. We contacted the Department of human services who told us that teachers do not qualify as caretakers and dismissed our complaint. The local police told us it was a school related matter and said we couldnt do anything else. I feel we should be able to press assult on a minor charges against the teacher. What are our legal rights in this kind of matter?
