I am a municipal firefighter in the state of texas that was injured on duty, upon going off off of work, the city makes you opt in or out of wage supplementation. the city workers comp. pays the 70% benefit and in their words pay you 30% supplementation pay. that when the injured worker recieves an impairment rating the 30% will be recouped back to the city from the impairment money. the city des not inform you of line of duty pay. under section 143.073 of thr local government code firefighters and police officers are intitled full pay for compensable injuries up to one year. I have a fellow fire fighter that they tried to do that to and he obtained an attorney and won. In my case I am about to enter the Contested Hearing Case with an Ombudsman that knows nothing of uniform civil servant workers comp. since 99.9% of their work is civilian. so my question to you is since my friend won his case and it's confidential can i use his case as an example even though the city has appealed and lost the first attempt but continue to appeal to higher courts. our cases are exactly the same the city is trying to recoup what they call supplementation pay from my impairment benefits. My ombudsman wants me to go into court pleading ignorance to what i signed... the two cases sited were APD 021162 and City of San Antonio v. Vakey
