My question involves landlord-tenant law in the State of: Virginia
I informed my LL my company might relocate me in July, 2 weeks after re-signing a year lease. On Sept 2 I notified LL via phone and text message that I would be relocating in a few weeks. In July, the verbal response was no problem, in September the response was you have to carry out your lease until May. My lease, has differing dates on it from the first year to the second, it doesnt even look like the lease I signed and it doesnt have the notation I made on it regarding my dogs and previous agreement.
Also, in July my roommate was asking the LL if he could be added to the lease, the LL at this time knew I was out of state already because I told him before I left I would be out of the area, the landlord noted both of us would have to be present, which I noted just take me off the lease and put my roommate on the lease which the LL replied with he does not qualify.
The landlord, was calling and texting me daily, that I need to come back and do the lawn, clean the carpets, etc. I was doing my best to pay for steam clean, lawncare, and keep in mind it is a duplex, with no formal agreement about the yard with tenants on the other side.
Also, please note, the unit was flooded in November 2009, so bad that I was in a hotel (on my own expense) for a month. The walls were never painted, doors never painted, once I moved back in after a month I found out a lot of my items (small personal ones) that I dont use daily were stolen. (which I never reported because I didnt know who did it, nor when). The heat never worked again, it took the LL until May to fix it. This past week I paid for steam cleaning and yardcare, Then the LL started calling and texting with there is a little spot in the corner that you need to come down here and clean, which I noted please use my security deposit.
On Thursday at 8 am I received calls about the doors needed painting now. I tried to talk to him, where as he noted all the doors need painting and I responded with so do the walls. He, as he does in every call, continued calling me a liar, and I noted if he kept talking this way I would have to get a lawyer, he noted he would take me for everything i have and then he would clean my clock you mother @#$#@$@#....which then he hung up on me. This is a normal conversation which I am sick and tired of having. How can I get out of this lease? I am tired of being insulted, I have a 3 page letter which notes everything. I realize my situation is not as bad as some people situation, any help would be appreciated though.
I forgot to add, after the LL hung up on me, he started texting me within minutes that he was no longer doing anything to support new tenants moving in until I formally provide his office with a letter stating I have abandoned the unit.
