    Default Transferring Physical Custody from One Parent to Another, Both Having Joint Custody

    My question involves a child custody case from the State of: INDIANA

    My ex husband and I have joint custody of our son, with me having physical custody. Our son is now 16 years old and he would like to live with his dad. (mom lives in IN & dad lives in KS) Both parties have consented to this verbally, and our son is excited. My questions are, do we have to go in front of a judge to modify who has physical custody? Is there a simple form both parties can sign since we've agreed upon it? Or can we simply have the papers written up from a lawyer?

    It's pretty simple if you're both in agreement. It shouldn't cost too much to have a stipulation written up by an attorney, and then submitted to the Court to have it signed off by a Judge.
