    Red face When Does the Statute of Limitations Begin and End

    My question involves collection proceedings in the State of: Texas

    I realize the Statue of Limitations on credit card debt in Texas is four years, but I cannot find what triggers the start date or ending date on this. For instance, the date the credit card company says was my last payment was 10/22/06. The lawsuit was filed in September 2010, but not served on me until 10/26/10. Is this within the statute of limitations?
    Any help would be greatly appreciated!

    Merely filing a lawsuit is not sufficient to avoid the expiration of a statute of limitations. Unless they made due diligence of trying to serve you and present evidence that there was good cause while they were unable to do so, you should be able to prevail.

    Generally speaking, a cause of action for a credit card debt will accrue on the date of your last purchase, the date of your last payment, or the date your last billed payment was due, whichever is most recent.
