    Default Why is Lawyer Doing Nothing to Pursue Claim

    My question involves malpractice by a lawyer in the state of: WI

    Minor injured in fall, property owner responsible. It's been three+ years, numerous treatments, drugs, physical therapy. Will continue to need care off and on for rest of life, doctor verified.
    Property owner joined Army, now deployed. Wife still at residence. Injured is still currently minor. Attorney has not contacted us since last fall, I have left messages, last contact I had I was told to let the attorney know when the owner has returned from service, then we'll do something.
    Why do we need property owner present to make claim to his insurance company? And
    Wife is also the owner of property, why can't she be held liable also?
    Just seems odd.

    If a lawsuit was filed, odds are the military member is exercising his rights under the Servicemembers Civil Relief Act and has stayed proceedings during his active duty military service. You should ask your lawyer about the reasons for the delay, as all we can do is guess.

    If you don't like the service you are receiving from your lawyer, there are lots of other lawyers you can choose from.
