    Default I-130 Question 16, After Previously Denied

    Back in 2003, my husband (a U.S. citizen) was a petitioner for my daughter (from my previous marriage) case I-130. At that time I was still waiting for a permanent resident card.

    The subject was denial, because my daughter was already age 18.

    This year I became a citizen and I am now petitioner for her. How am I suposed to answer question 16: ''Has your relative ever been under immigration proceeding?''

    If she was the subject of an immigration proceeding you would answer "yes". The mere filing or resolution of a prior petition is not an "immigration proceeding".
