    Default Is Child Support Modified when Custodial Parent Moves Out of State

    My question involves child support in the State of: CA/NV

    Currently both the custodial and non-custodial parent live in CA. There is child support established and in effect in the court of CA. The custodial parent is wanting to move to the state of NV. How does this effect the established child support? When moving a child support case, can the new state decide to increase the amount on their own terms or does it stay the same?

    The case will remain in CA as long as one of the parents is in CA.
    If you wanted babies all to yourself, you should have created them by yourself. Until you do that, children have the right to BOTH parents, especially since you found them suitable to procreate with.

    the custodial parent can file for the new state to also be involved and CA should still be in charge.

    Same thing happened to me, we had order in one HI, CP moved to WA and filed there then moved to Cali and filed there but now lives in back WA. HI collects and send it to Cali who send it to CP. Untill she files in WA, CA is still doing it and currently keeps sending me threats of back support. CA has levied my bank account but HI says Im current and still collects from me. HI does claim to be now enforcing a HI order for CA.
    I am still and have allways been a resident in HI.
    at one point I had HI collecting, WA threatening my employer and California threatening me with legal actions all at the same time! I finally got WA to drop and California now collects thru HI but still threatens me and takes my federal return. HI and CA both have different amounts! I only have one child.

    To say anything is set in stone is by far incorrect.

    I've worked in CA Child Support for over 12 years. I take it that there is already a child support court order in California. Making that assumption the order would stand and CA would still have jurisdiction over the court order as long as one of the parents reside in CA. The mother could ask the state of Nevada to open up a case however if there is already an open case in CA then NV would more than likely make it an interstate action and have CA enforce anyway.

    Hi, I am currently in the same situation. I'm from Indiana, my daughters mom moved to GA, then to OK (put me on child support there) and then moved back to GA. My question is, How did you get out of that situation? I hate dealing with a state that she doesn't even live in. I have also been threatened and have had my bank account levied. I just recently received a letter threatening again, even though it is automatically taken out of my paycheck. So they are getting their money. What should I do? Any advice?
