    Default Can I Change My Employer After Contracts Have Been Sent to Present Employer

    Hi
    Iam currently working with a client who subcontracted to consultant A. This A was not willing to file H1 for me so i found another consultant B to file my h1 . My contract has recently been extended last month to 8 months and i am facing lot of problem with employer A .
    so can i talk to my client directly and change my employer to B removing the middle layer. My H1 is not yet filed and it might take another 2 months for my H1 to get approved.
    Do i have to keep quite until my H1 gets approved and then change my employer or can i do it now . Some said it is difficult to remove the middle layer as my contracts has been already sent on employer A . Can i ask my client if they could send new contracts to employer B instead of employer A now ? or is it better for me to wait until my H1 gets approved and then ask them if they could change my employer to the one filing my H1 , but then it would be another 3 or 4 months and it might be more difficult to sign contracts to employer B

    Could some one please help me in this .

    If you're asking if your contract of employment imposes a penalty if you switch employers, forbids your working for a client of your present employer, or includes a non-compete agreement that prevents you from taking clients to a new employer, we have no access to your contract of employment. I'm not clear about what your present status is, or exactly what you're trying to ask.

    Take all of your documents to an attorney for a proper review and advice based on the contracts and laws of your state.
