    Default Need to evict room mate not on lease

    I'm in CA.

    I have a roomie who's name is not on the lease. He has never paid rent directly to the landlord, always to me. Now he's in arrears and refusing to pay and I want to evict him.

    What is my legal standing in California? I've been told that I can give him a "Thre Day Notice..." and I've been told that I'm out of luck until the lease expires. Does anyone know anything about this situation?

    I've spent hours looking at the CA court self-help website, and others, but all of the info seems to pertain to tenants with a lease.

    Thanks in advance for any insight.

    Default Roommate doesn't pay rent

    The roomate doesn't have a contractual arrangement with your landlord, so the courts would probably view him as your tenant. If rent was to be paid monthly, he would have a common law month-to-month tenancy. He should also be subject to the three-day notice for termination for nonpayment of rent.
