    Default Coming Foreclosure and Lien on Property

    My question involves a foreclosure in the State of: Minnesota

    I had to put my parents in a nursing home and apply for Medical Assistance (M.A.) to cover costs. The state of Mn. put a lien on the property. The house had to be put on market but has not sold and a foreclosure sale is scheduled for 12-2-2010. If the foreclosure goes through will my parent's M.A. be effected since the state will be receiving no proceeds from the sale? The house is in my parents's name.

    The lien only covers what can be recovered. If the more senior liens (mortgage, taxes) are more than what the property sells for the state is out of luck. Since you didn't fraudulently convey the property, the state takes what they can get and your parents still qualify for the assistance.

    Thanks for your reply! Are there MN. State /M.A. lien guidelines I can refer to in case the person @ Human Services who is responsible for my parent's M.A. comes after me if the house goes to a foreclosure sale? She has been difficult to deal with in regards to this whole affair-providing me with false and misleading info. when she told me the lien would be lifted if I transferred the house to my name and I found out afterward that it wasn't true, lost an appeal etc.

    you are not liable for your parents bills unless you accept liability.

    Did you sign something accepting liability?

    The only thing I signed was the M.A. application form for my parents.
