    Default Denied Entry Due To Conviction In Canada

    A while back, I was refused entry into the USA because I was being charged with an offense. Now, I don't have a record here in canada (due to winning the case) but the USA doesn't recognize that, so I can't cross the border.

    Now, I've got a potential job lined up in Vegas, and wondering if I got the job if it would be possible for me to actually work there. Does an employment visa override my ban from the states? Is there something the employer could do? Any advice appreciated

    PS I did apply for an entry waiver 2 yrs ago, but recently received a letter denying my application.

    The USCIS should recognize an acquittal based upon innocence, or a Pardon issued by Canada on the basis of innocence. If you are excluded from entering the U.S., having a job won't change that. You should consider consulting a U.S. immigration lawyer to try to get this straightened out.

    That's the thing, the US gov't doesn't recognize foreign pardons. I know of someone who was charged with shoplifting 20 years ago, pardoned and everything, still needs to apply for an entry waiver every 5 years.

    I just might have to call a lawyer though, thanks for the advice.

    The U.S. can be convinced to recognize foreign pardons if properly documented and based on actual innocence.

    I spoke w/ an immigration lawyer today and he mentioned that with an offer of employment, there's a chance of getting a tn visa... anyone shed some light on this?

    The immigration lawyer you are consulting should be able to answer any questions you have.
