My question involves a speeding ticket from the State of: Oregon
This is my first ticket. Speeding.
I am traveling from WA to CA on I5. So the max speed on the road was 70 at some places, 65 at some and 60 at some.
The traffic was flowing at 70. I am also going at 70. But suddenly the max speed reduced to 60. And exactly at that time, due to application of brake,
i lost control on cruise control and it seems like I speeded to 80 ( from 70) for 30 seconds. I immediately I realized the increase in speed and reduced it.
Exactly at that time, I saw police behind me. He said I am going above the speed limit and gave me a speeding ticket of $287.
But I am a decent careful driver. I always use cruise control especially on inter state high way. When I changed the lane from second to first, my speed suddenly reduced.
Suddenly it flashed on my mind that due to some reason, I gently applied the brake and the cruise control was turned off.
As you know, when cruise control of a vehicle is turned off, the vehicle slows down. So immediately I have to apply accelerator just to come up to speed and not to cause traffic on the first lane to slow down.
But for 15 seconds, my speed seemed to exceed 70 . The moment I realized that, I reduced my speed. By that time, police was already behind me.
With above explaination, can I apply for a trail. Can the above explanation convince a judge ?
