Can a Marriage Be Automatically Annulled

I was married in 2008 in India.Stayed there for a month.Me and my husband never consumated the marriage.I came back to canada and found out that he was cheating on me with a girl who he was involved with before we got married.I have not gone back to india and its been over 2years already.My husband has the marriage certificates and refuses to give it to me.I don't want to go back to India either as i am afraid his family will be waiting for me since i no longer want to stay in this marriage.
My question to you is that since its been over 2years since i have not contacted my husband,IS this marriage considered automatically annulled in the 3rd year?

No. A marriage is never considered "automatically" annulled or divorced no matter how much time has passed.

(In the US and Canada, at least - India may be a completely different story).

So how long does the annullment process take and how long after getting the annullment is a person allowed to get married again?
