First Time Possession of Marijuana

My question involves criminal law for the state of: Michigan

At about 4 in the morning I was driving home and I was pulled over by the police.

The officer questioned me and eventually I gave up the marijuana I had in my center console. After I gave up the marijuana I was put in the police car and another cop that appeared on the scene searched my car. I had nothing else in there except the marijuana I already gave up. Once all that was done the officer had my car impounded and I was driven home. I am not a minor.

Basically my question is should I get a lawyer? What will the penalties be?

Any insight would be helpful, I am quite unknowing when it comes to handling police and court stuff.

I am afraid it will effect my schooling and I really didn't do anything THAT horrible...well I think anyways..

I'm assuming you're in college. If you're in Ann Arbor and you were off of campus, lucky you. If not, you are being charged with a simple misdemeanor possession without intent to distribute or in the presence of a minor (both good things for you). The most unfortunate part of Michigan's possession laws is the 6 month suspension of your driver's license. You will likely want to speak with an attorney about a 7411 or HYTA (only available to people under 21) which will defer charges for about 6 months while you serve probation. If you are offered this you will plead guilty to the misdemeanor charges in exchange for an expungement of the charges after your probation sentence (maximum of 3 years with or without reporting/drug testing). Do not violate your probation or screw up if you are forced to report to a probation officer, it will nullify the conditions of the 7411/HYTA. Talk to a lawyer ASAP.
