Dad Now Has Physical Custody, Does Ex Now Pay Support

My question involves child support in the State of: Nebraska

Hopefully short. Due to to neglect and child endangerment with alcohol, drugs and parties at Mom's house Dad now has physical custody of teenage kids. Modification paperwork has been filed.

How much weight will judge consider the evidence in poor judgment and past behavior in requiring a payroll deduction of the Mother rather than voluntary payments? She has vehemently stated she won't pay child support.

Dad should go to court to modify the current child support order.

Her past behavior will be irrelevant; he'll only get CS retro to the date he actually files.

The Modification has been filed, but she convinced that she will not have to pay child support. Because of her statements to this fact he is asking for automatic payroll deduction.

Another question: He is getting statements from school counselors and their parents friends to support his full custody request. Should all of them be signed by a notary.
