    Unhappy Passport Denial Due to Child Support Interest Arrears

    My question involves child support in the State of: West Virginia

    I live in Australia, my partner & I have made arrangements for him to come to Australia for 6 weeks on a tourist visa. I have booked & paid for his ticket & he has since been denied his passport due to Child Support arrears. However, he has been emancipated from Child Support, & he has documentation stating this. What he is now paying back is interest which is calculated at a ridiculous rate of 20%, he has been advised that for his passport to be issued he has to make a payment arrangement. He has been making monthly payments and this has been confirmed by the office in New Mexico, he then proceeded to increase his payments so as to try & get rid of this debt & was advised that the office in West Virginia are the ones to approve the increase & certify to the Passport Office that an arrangement has been made. The ticket is booked for him to leave on the 30 October, what can we do???

    He owes a considerable sum, around the $15000 - $20000

    He can pay it down to under $2500. He can get a loan if he has to.

    Next time dear, don't pay for someone to go clear across the county when he can't support or didn't support his own offspring. I know, I know... it wasn't fair. His ex screwed him. He never knew the kids existed. All that...

    If you wanted babies all to yourself, you should have created them by yourself. Until you do that, children have the right to BOTH parents, especially since you found them suitable to procreate with.

    You know what...I didn't write this post to be put down by you, I was asking for some advice as to what can be done. He did know he had kids, he actually looked after them by himself for quite some time. He has paid his Child Support since they were little, they are now in their 20's and if you read my post correctly he is now paying interest calculated on the administration of that Child Support. And I really don't need to justify my actions to anyone.

    If he had been paying his child support, he wouldn't have $20k in arrears to pay off....someone somewhere isn't telling someone the truth...

    Well I'm gonna say thanks for nothing. Instead of reasonable advice, all I have received is negativity. But somehow that doesn't surprise me really...I'm not bothering to waste my time any further on this site..

    It all depends on what the monthly CS amount was and how long he has been paying. For example 20K not too much if you have been ordered to pay $1500/month over a 15 years. A missing years would easily accumulate over 20k in arrears. Doesn't mean he wasn't paying CS. Means he had a bad year.

    Excellent point. But courts absolutely can and DO modify support when things that cause bad years like job loss, decreased earnings, medical issues or injury, and other circumstances beyond the control of the payer arise. Either the circumstances for non-payment were within his control, in which case the burden was on him, or the circumstances were beyong his control and he either didn't bother to get off his duff and file for downward modification or he wasn't able to substantiate those circumstances to the court.
