    Default Shoplifting Under $3

    My question involves criminal law for the state of: NM

    I was caught for shoplifting an item that was under three dollars in the state of NM. Does anyone know of a website where I can view the actual NM state laws regarding shoplifting?

    Can you go to jail for stealing something under $3? The cop threatened to take me to jail numerous times. In addition, he also said "if it were up to me, I would have a firing squad for all thieves," and "I'm not legally allowed to shoot you but I'd like to". Could these statements be considered threats and held against the officer?

    I also bought items at the store, about triple the amount of what I stole. I have the receipt for these items as well.

    Misdemeanors are crimes which may result in fines, jail time of one year or less and rehabilitative programs. The penalties for misdemeanor crimes may include:

    Petty misdemeanors:
    up to 6 months in jail
    up to a $500.00 fine
    up to 6 months probation
    community service
    license suspension
    driving record points assessed
    recorded NCIC conviction
