    Default Back Child Support After 38 Years

    My question involves child support in the State of: Florida

    If child support was not payed out to (2) children under the age of 18 and now the children are 48 years old and 50 years old. Can those children collect back child support now?

    The father left the mother without paying for a 10 year old and a 12 year old.

    The children have no standing at all to sue.

    Dad is what - at least 70 years old, correct? What do the adult children hope to gain from this?

    If he is, then a little niceness, might land them with a big inhertance. But then again, trying to get child support from him after 38 years probably kills that option.

    Is there enough siliva in an 70 year old man to get a proper DNA test?

    I am 48 years old, he abandond his six kids when I was 10. My mom was a stay at home mom. My dad did not want contact with his kids, till today...haven't talked to him for over 35 years, maybe an email here and there. The point is, he abandond those two children 10 and 12 that left my mom to get assistance. My dad has sense remarried with two successful girls. One a pilot in the navy and the other a doctor. He put them through school, I quite school in the 11th grade to work. There was no money in the house. Today, I seek to collect back pay because he can afford it now. He left my mother for a MUCH younger woman who took everything he had, then married this one who he had the two girls with. My point is just the question...can I collect those 8 years of back child support?

    To Dogmatique: I seek "Justice" now and now that he has the money, he should out of respect for his children (which he has YET to show us) owe them what is due, if not to the children, then to my mother!!!

    You have no standing to sue your father.

    Sorry.

    That's the legal reality.

    The only person with any standing to sue would be either the State or your Mother, and even then only if there had been a child support order in place at the time.

    haha, my mother is 89 years old which NEVER remarried mind you and my "father" is 80 years old and is still married to his 50 year old wife with the two girls

    Dogmatique: That's great, so my mother could sue him for that, correct? At the time 1973, court order was for him to pay two children child support, he ran from the law and his responsibilites. Thank you for your comments.

    No, the court order was to pay FOR two children. Not to pay two children

    Here's the problem.

    Even though FL has no SOL (statute of limitations) for collecting back child support, she may be faced with the issue of doctrine of laches.

    She has taken NO action to enforce this court order, correct?
