    Default Being Sued Personally, Should Be the Company

    My question involves court procedures for the state of: Oklahoma

    I am a property manager and manage various different homes. I have a tenet who is suing me personally and not the real estate company which is an LLC.

    The agreement that she had was signed by me, but as the manager and on the letter head for the real estate company.

    I refused to give her deposit because because she left a mess and all total I have $900.00 into clean up after painting, cleaning the carpet etc. She also took the filter out of the AC and did not replace it, I had to have the AC serviced and repaired. I have a bill for everything.

    I want to remove me personally from the suit and have her refile against the company. How do I do this?

    Bring a motion with the court, supported by adequate legal authority and documentary evidence, arguing that you are not the proper defendant and that the lawsuit should be against your LLC.
