    Either the bicyclist was traveling in the same direction on the wrong side of the road, or he was riding in the opposite direction on the correct side of the road; either way he was hit close to the center of the roadway. It would obviously help to have that information, as well as to know if the newly introduced matter of riding on the sidewalk involved a municipality in which the sidewalk was a designated bike path with bicyclists maintaining the same general right-of-way rights as motor vehicles.

    The insurance company apparently sees the driver as liable, but there's nothing to suggest that they've admitted liability.

    rymfire4, It was a one-way street where mry brother was turning onto, infact the biker immediately agreed that he was at fault, but again that holds no value as it was a verbal acceptance of fault. The injury was not severe, he was at the hospital just for a day. Yes, I kind of feel cheated by my brother's insurance company, as initially they gave a feeling of everthing is undercontrol & now they call him to ask how much can he pay over the amount covered by insurance!

    Don't you have a good argument that the biker actually ran into you based on the angle of contact? If he was riding in the sidewalk did he have the right-of-way? Was the car expected to yield?
