Rental truck has insurance but the driver does not.

Hello everyone…

I was involved in an accident were the driver who is at fault was driving a rental moving truck. The company has insurance but the driver and whom ever he injures does not. What can i do about the situation?

My bike was totaled , I spent a week in the hospital and i just went back to work after 6 months of treatment.

The rental company, driver, you, and the accident are all from/in Florida?

Yes aaron, everything happened in FL. I am from Kissimmee FL. And it happened in SR. 192, the police found him guilty and gave him a ticket for reckless driving.

There may be coverage available through the rental company's policy. You may have an "uninsured motorist" provision in your own insurance policy. There may be a policy held by somebody in the driver's household through which coverage is available, even though the driver wasn't a policy holder. If he was charged with a criminal offense, you may also be able to make a claim for restitution through the criminal court.

I was told that our wonderful president posted a Law last year on October, were if any individual who is driving any rental vehicle does not have insurance, the rental company is not responsible for any injuries or losses of any individual who by luck gets hurt in the process.

It shouldn't be a law from our wonderful President, but in Florida it may well be a law signed by the brother of our wonderful President.

That one part I am not sure of , but I do hope that something can be done about the whole situation.
