Ex-Spouse is On Probation for Cruelty to Children

My ex is currently on probation for cruelty to children in the 2nd degree. A couple months ago I found out she had the sheriff's office called out to her house our child was walking down a busy road in the early morning. The officer went into the house and it was HORRIBLE according to the police report. He called DFCS and they came out and made her remove the kids from the house for 24 hrs. How much weight is this going to have on our case when we go, as far as custody of my kids? Keep in mind, when both of these incidents occurred, I was deployed.

Right, she divorced me while I was deployed and when I got back the judge set the case aside. Now that that has happened, there isn't any custody order for the kids. She still to this day will not let me take the kids home with me, because of her shoddy past. Last time I was able to have any kind of interaction with them was in May. We have a temp. hearing coming up for temp custody and temp child support. My past is clear, no previous record, knock on wood, not even a minor traffic violation.
