    Default Can I Be Emancipated, My Parents Are Against This

    My question involves emancipation laws for the State of: kansas

    Hi i am sixteen years old and live in El Dorado, kansas. Im in butler county and im looking to emancipate myself. Here is my situation, i live with my step dad and step mom and he lives with his mom. he is a dick to me and everyone and treats us all like crap, i work my butt off all the time and he is lazy and always tellin me how im not going to go anywhere in life and always talking down on us. Also he goes off on me for no reason just the other day he picked up a glass jar and told be he was going to break it over my head, he has punched me and left a black eye before. i have a couple of adults who think this is unhealthy because all i ever do is work and dont play very many sports and they all tell me that im a kid and should enjoy it and not have to work all the time. i do have a job and i have a vehichle that i paid for, my grandma lent me the money and i paid her back, all of it. i put my own gas in my truck and i pay my own insurance also i make straight A's in school, i do not buy my own food, my dad gets 1000 dollars a month for five kids in food stamps (because he wont get a job). i just cant handle him talking down to me and pushing and shoving me around and slaving me all the time, i like to work but not like this. i want to be emancipated, i have a friend who lives four miles north of me and his mom told me she would let me live with them, i am not disturbing them by this, she has told me that if it were up to her then i would go live with them. i want to know if im declared emancipated can i live with them until i can get my own place? Also i want to know if my situation is capable of making me emancipated? your advise is very helpful.

    Watch your language, kiddo.

    Do you have a history of supporting yourself, with NO help? That means housing, utilities, food, car payments, car insurance, medical insurance, staples, phone, cable, etc.? On a part-time job? Not unless you're starring in movies.

    No judge in the world is going to emancipate you so you can go live with a non-family member.

    If you are being physically abused, contact a trusted teacher or counselor, pastor, or call Child Protective Services yourself.

    Doesn't ANYBODY read all the stickies at the top of this forum?

    like i said i pay my own insurance, bought my own truck, pay my own phone bill and i still have money to spare. theres ten of us in out five bedroom house. and i cant handle him holding me back and denouncing me. so you rele dont think a judge will emancipate me? and my real parents live in wichita.

    Insurance, truck payment, and phone bill are good starters....but can you prove to a court's satisfaction that you can ALSO afford rent (the going rate in your area, not a "discount" from a friend or family member), electricity, water, cable, internet, health insurance (of your own, not riding on parent/guardian policy), and 100% of your own food, clothing, etc. (in other words, SEVERAL part time jobs, or a good paying full time job)? While at the same time maintaining above average grades?

    No, a judge isn't going to emancipate you on the grounds you've stated, especially since you'd need to be supported by someone ELSE for a while (the whole POINT of emancipation is that you, and ONLY you, can and do provide for ALL of your own needs - if you need help from others, you don't qualify).

    You have no chance of being emancipated.
