Will Expunged State Criminal Records Show Up on a FBI Background Check

Ok I hope this is not a dumb question.


1. If you get a " dismissed charge" EXPUNGEd in North Carolina, will that show up on a FBI background check?

I have read something on the NC DOJ website that said that it will not show up, but the first "google search" says an expungement only fixes an SBI record. Any thoughts? Please be clear if you help me. (this stuff can be very confusing)

I've asked this next question before, but i never got a straight answer.

2. Can a expunged charge be "refiled... reinstated ... etc etc"

The FBI does not have to follow a state court's expungement order. The only way to know what is in your FBI record is to obtain a copy.

By the time a charge is expunged, the prosecution phase of the charge is over.
