    Question Opinions on Visitation Modification

    In a few weeks, I am going back to court, for visitation modification.
    I get him (my son)1 weekend day, and *unofficially* for 2 hours on a tuesday night.
    I am trying to get the *unofficial* 2 hour to be *official*, as well as 2 hours on Monday night.
    Not alot to ask really.
    I have never missed, or been late on a child support payment.
    My sons Mother is still very bitter, and is trying to take my son away.
    Is there any reason for the Judge to stop my visitation?
    I got paperwork today from her lawyer asking the court to dismiss the case, solely because my ex doesn't agree with the fact that my child wants to spend more time with me ( which is NOT the case ) (my son is 9 yrs old)
    I don't have a lawyer because...
    A)They are all bloodsucking leaches who will lie under oath and stab their own mother in the back
    B)Can't afford 1
    C)Don't think I actually need 1, as I see it as pretty cut and dry.
    Also, anyone know how to go about using the court appointed mediators? It's impossible to actually speak to my ex, without her flying off the handle.

    The best way to lose a custody case where the other side has a lawyer is to insist that everything is cut-and-dried and to not hire one yourself. If things are as easy as you think, the legal fees should stay pretty low.

    Just a quick update if anyone cares.....

    Well well well, seems the ex's case wasn't as strong as she thought it was.
    Quick recap, I wanted a little more time with my son, and the EX refused, so, off to court we went.
    I'll try and keep this day in court as short as possible, as not to bore anyone.
    We sat down ( myself, the ex, the ex's attourney, and a probation officer to keep the peace )
    The first thing her lawyer fired off was the fact that I didn't take my son to a soccer game 8 months ago (for which I had a very valid reason). I responded with "Is that the best you have?" I know it sounds like a wiseass remark, but that was the first thing out of her mouth, totally unrelated to anything. She was trying to portray me as a bad dad right off the bat. So, I gave SEVERAL of my "bad parenting" examples about the ex.
    I brought up the fact that my son was sleeping on the couch at the boyfirends house 7 nights a week. The moderator wasn't pleased with that. Come to find out, the ex is getting a place with her boyfriend, and the moderator made her tell me in what area she will be moving too, as this would have a direct effect on the visitation schedule. I mean, if she moves 2 hours away, this court date about visitation schedule means nothing. My ex also said that she would like to move out of state, but she knows I won't let her. I responded "Damn right"
    Moderator sided with me.
    Visitation agrument finally came up. After the other side tried to prove that I wanted what was best for me, and not my child, I responed.

    Last but not least, the child support came up.
    My ex and I agreed 3 months ago, not to change it, as it was only a few bucks difference. Turns out her lawyer not only wanted that few bucks more per week, but wanted arrears. I told her flat out, I wasn't about to pay arrears, as the ex agreed not to change it.
    I reached into the stack of paperwork to find the e-mail, and the moderator told me not to bother, it wasn't necissary.
    Moderator sided with me. Her lawyer "did me a favor"( her words, not mine), and waived the arrears. So now I pay another $20 per week.
    So, all in all this is when I ge tto see my son.
    Every other weekend, from fri 6pm to sun 6pm.
    Tues and thurs nights from 6pm to 8pm
    April vacation is mine
    1 week in August is mine.
    That sure beats 11-6 on sundays and 6-7:30 on tuesdays!!
    And the good news, I only lost my temper once during the whole discussion.
    But hey, when the snake lawyer threatens me, that's probably going to happen.
