    Default How Long to Respond

    My question involves a child custody case from the State of: Texas

    I was granted an order Adjudicating Parentage approximately 30 days ago. The order outlined conservatorship, support, etc. The mother failed to appear in court, and failed to leave a forwarding address for her mail. The paperwork was given to her on the 5th of this month in person by me. In order for her to file to modify anything outlined in the order, how long does she have? And does that time start from the day the order was signed by a judge or the day she received it?

    A modification of any court order requires there to be a change in circumstances that has happened since the order was issued.

    Since this is a brand new order, only 30 days old and Mom failed to appear at the hearing, she'd have to have a HUGE change in circumstances to be able to get a modification request heard at this point.

    That is if you are talking about a modification and not an appeal.
    Is she wanting to appeal the order, or is she wanting to file for a modification?

    To be blunt, I am assuming that she wants to modify the order, but I don't quite understand the difference. Were it that she wanted to appeal the order instead, how long would she have?
