    Default Can You Go to Jail for Not Paying a Medical Bill

    Hi I am from the State of Indiana

    I had cartilage removed from knee ,after it was done the doctor said if he knew it was that bad he would not went into the knee ,he told me i need a total knee replacement along with the bone beside the knee and it will take me a year to learn to walk again and that would be depending on how i come out of it ,now they have a bond for my arrest for payment because they say the insurance did not go through after i was told every thing was good .from that date my knee is gotten worse to were i can hardly walk ,cant stoop down ,set for long.

    My question is the insurance company authorized the surgery,2 months latter the insurance company refuses to pay the claim.Now I am liable for the payment I don't have the money.This surgery was 8 years ago,I have received A bond notification informing me that they are filing against assets to get the money.can i be arrested for this and go to jail or prison. thank you julie u

    No, you cannot be arrested or sent to jail for not paying a bill, medical or otherwise.

    However, you can be sued.

    since they have a bond on me is it possible
    say for example, if i get pulled over by the police will i be arrested because of the bond .

    No.

    You will not be arrested for not paying a bill, even if there is a civil bond against you.

    What do you mean "a bond."

    Do you mean they already sued you and got a judgment?

    If they have not sued yet, they would be beyond the statute of limitations.

    If they did sue you, why the frack didn't you file a cross complaint against the insurance company?

    Was there a civil action already or not? Did you have an attorney?

    To be more specific, the Indiana Constitution forbids imprisonment for a civil debt unless in cases of fraud.

    Bill of Rights;

    Article 1;

    Section 22. The privilege of the debtor to enjoy the necessary comforts of life, shall be recognized by wholesome laws, exempting a reasonable amount of property from seizure or sale, for the payment of any debt or liability hereafter contracted: and there shall be no imprisonment for debt, except in case of fraud.

    Fraud here means basically either hiding or fraudulently conveying assests (signing over assests to avoid a judgment).

    If you are sued and you have 5 grand socked away but claim you have no money, that is fraud.

    NO, you can not be arrested if stopped. Such info is not even in the police's database computer, it is a civil matter.
