My question involves an eviction in the state of: PA, city of allentown
Landlord is a slumlord, lied to my mother(the renter) for 3 yrs now leaving her, her elderly mother, adopted nephew, daughter in-law and 3 small children(1yr, 2yr and 5yr) homeless. filed bankruptcy, now he is forclosing the house and gave us a 30-day notice to leave. we were told the house was going to stay opened and given to the property manager/realtor and the next owners would decide what to do(move us out or keep renting to use). from what im told, we were suppose to get a 90-day notice about the forclosure, the landlord told us nothing about the forclosure till the last month after he got his last months rent because he wanted the money and knew he would risk not gettin the last 3 months rent so she could afford to move out.
how much of this is true? what can we do legally against him?
how do i look up landlord/tenant law for my city/state?
can anything that happened during the first year be held against him now?
do photos or video of the house/damage help?
the long story:
We have lived in this home for about 3 yrs and 4 mths, we always payed on time, never late, always within the grace period given. the house wasn't in great condition when we moved in, all things that were in poor or bad condition, we were told by the LL himself that they would be fixed. he attemped to fix a few things, cheaply or by inexperienced handy men which just temporarly fixed a problem and it just came back later or made it look worse then what it was. he never checked their work, just sent someone to the house, payed them and asked my mother, someone that knows nothing about home repairs, if they fixed the problem. some repairs left rooms in the house unusable for 2-3 days, caused breathing problems for the asthmatics in the house(4 out of the 7) or mold would grow quick where they should have sealed it off with caulk.
during the second yr, after all these problems came up and he refused to fix anything, he tricked my mother. mailed her a lease, told her send it back to him asap, said it was just a renewal, did not mention any changes other then the rent would be raise to help cover repair expenses. ofcourse being an overly trusting person, she just signs it and sends it out. Come the end of the 2nd yr and calling back and forth the property manager say we have to pay for all repairs, something about a repair and indemndification clause.
the repair section saying she has to pay up to 150 for each repair. the indemndification clause says basically if anything happens to anyone/thing in, on or near the property, we are responsible for any damage, legal dispute or death. so, if my elderly grandmother dies because the leaky roof caved in over her while she was sleeping, we have to pay for everything ourselves, our loss would would be nothing to him at all, even tho he knew the roof was damaged prior to us moving in. the roof caved in during a rainy day, luckily no one was hurt, we had a hole in the main bed room ceiling for 4-5 months.
after the call to the PM and the talk about the lease, we call our local housing authority/inspector and he came to see the house. he inspected the house and found many things wrong with the home, close to inhabitable, told the landlord about things he had to fix or he would be fined. the main were the roof/ceiling of main room, a railing from the 1st to 2nd floor and to rewire the electrical in the basement (bare wire or no fittings around wires going into junction boxes), he fixed the roof, ceiling and rail but, convince her not to call the inspector again cause of lack of money. made a deal to keep rent the same price, switch to a month to month lease and not raise it the rent again.
another year passed, not much was fixed, he went for bankruptcy, had his hearing about 2 months ago, now we are being kicked out in less then a month and we have no clue what to do, no money to move out, no where to go, no money for legal help, no knowledge of what to do next. how this is understandable to you and doesnt come off as a rant, i put as much info as i could with out making it in to a book. thank you in advanced for any help.
