    Default Workplace Retaliation

    My question involves labor and employment law for the state of: North Carolina


    I reported conflict of interest issues and work place violations to my H/R department. The main people in question was fired but his remaining friends that are in management stop communicating with me or answering my emails concerning work issues. I was subjected to a wall of silence from several members of management for speaking up about the on going issues in my area. One of the mangers communted false statements made by myself to another manager. I filed a griveance with H/R about how this person was treating me. Instead of dealing with what was going I was told to go on blind trust for this person and restricted from dealing with any other employees but this person. When I asked why would I want to deal with anyone that treated employees that way I was told this will help her become a better person.

    I handed in my notice and would like to sue ...I feel I was retaliated against for speaking up

    You can sue your former employer only if it has done something illegal. Retaliation is only illegal if it's undertaken against someone who reports illegal activity to relevant judicial/regulatory authorities (such as the police, the district attorney's office, and government regulatory agencies).

    From the information you have provided it doesn't seem that your former employer has violated any laws by retaliating against you. Even if the issues you reported to HR constituted illegal activities, HR is not a judicial/regulatory authority as described above. As a result, your former employer was legally free to retaliate against you, and you have no grounds for a lawsuit.

    BTW, what does your union say about this?

    There was several regulation "B" violations that as far as I know still haven't been addressed.
