    Default Waiver after deportation

    My husband of 3 yrs was picked up by immigration on august of 2005 due to a misdeamenor. He pleaded no contest to a misdemeanor charge and accepted an advance parol deal where he didn't have to serve any jail time and had to pay a small fee; he wasn't guilty, he just didn't wanna go through the whole court process to prove it and the court never told him the immigration consequence of accepting the plea.
    We then tried to fight his deportation back to Morocco with the help of Bel-Ami J. Demontreux, a lawyer in SLC, unfortunately we were unsuccessfull. He had to spend 3 months in immigration detention center in Eloy,AZ;
    fighting deportation so he can stay with me as I was pregnant with our first; but he lost all hopes due to judge denying everything and treating him with a clear inferiority and disrespect.
    There is a 10 yr bar and I am aware of the waiver which we're planning on filing it to try and get him back here; please do you think the fact that our daughter is now born and the real hardship we both going through can help our case in the I-212 form, on the one hand, he's unemployed back in his country, I don't why, but he was really smart and had a very good job here. On the other hand, I'm just getting by living on social security, and his daughter is so adorable growing up without him here. We have spent all our savings already with the lawyer, and can't afford one now, so please any advice on how to file the form properly and what to include. Or is there anything other than the waiver we can do.

    It would be wise for your husband to seek the help of an immigration lawyer in applying for a waiver. (I appreciate your economic situation, but as you note he is capable of working.) He can apply on his own - I know nowhere near enough about the case to estimate his likelihood of success.
