    Default Durable Power of Attorney

    In Michigan, does a durable POA have to be witnessed by a Notary Public or can two disinterested witnesses witness the Principal sign the document.

    See these statutes. Based upon those statutes, in general there is no need for witnesses or a notary. For a healthcare proxy or for certain transactions, such as executing a deed, notarization is necessary. In practical terms, though, you should not expect that anybody will honor a power of attorney form that has not been notarized.
