    Default Father Says Not to Show Up in Court Tomorrow

    My question involves a child custody case from the State of: California

    When my ex left he originally moved to AZ, so we had a visitation schedule set up where we exchanged half way. Well, he has now moved to TN so now our daughter has to fly there. He quit his job in AZ and moved to TN, since his wages were being garnished he of course stopped paying child support. He told me via email that he had a job but was taking a short break from paying.

    Anyway, when I filed to get visitation revisited they said there a new ruling here that we each had to take a parenting class before we could get into mediation. If you fail to take the course (I had to take it in person he could do it online) then you could be fined $150 and you we wont get a mediation appointment until we have both completed the course. He was aware of this and I guess argued with the mediation people that he had taken it back in 2007 (we were both court ordered to take the online class but they told me I had to take the real class again). the court date is tomorrow, we didn't have a mediation appointment because he was arguing he took the class already and just ended up redoing it online but hasn't gotten it submitted. He also said that he couldn't compete his income and expense because he is waiting for his newborn daughters social security card (which I'm not sure how him having another child effects his child support to his current).

    Anyhow, i think he is stalling because if he files his income and expense then we know where he works and his wages will be garnished. I asked him and he said they might move back to AZ he's not sure so he wont provide employer info, even though just weeks before he told me he was working. But my question is tomorrow he said I don't have to show up to court because the clerk told him the judge will just continue the case because of the class confusion. Will I get a chance to at least protest this continuance? He had a month to get the class done and all he had to do was do it online! is there a chance the judge will decline him and order him to supply his employment info?

    Is there anything I can do to help make sure this gets resolved?

    SHOW UP FOR COURT! There's a chance he could be bluffing, hoping you won't show up.... Even if you do get a continuance, Always show up.

    You have a court appearance scheduled. You need to be there.
