My question involves a speeding ticket from the State of: New York
I live in NY, my son (19) lives in NJ. He comes up for dinner typically every Sunday. One of those visits he got a speeding ticket (42 in a 30 I think).
The issue is not the speeding. He checked the Not Guilty portion of the ticket and mailed it in before the deadline. But what he didn't notice was that the address on the ticket did not match what is on his license. To note, the address on his license IS correct.
Subsequently, he never got the letter with his court date - and being 19, didn't even remember it, so he never followed up.
Now, of course, he received a letter for a warrant for failing to appear. Suddenly, NY realized they were sending his notices to the wrong address (their mistake).
So my question is, does he have any recourse? Not on the speeding ticket - but the failure to appear charges. And the fact that his license is suspended in NY.
Any advice is appreciated.
