    Default Failure to Yield at a Traffic Light Accident

    My concern is about an accident that happened in the state of Colorado, Denver

    We were in a 35mph street approaching an intersection with good distance to stop before the traffic light. The traffic light turned yellow , my husband looking that the car behind was far from us stopped at the yellow light , after the full stop the light turned red. However the car behind us instead of stop accelerated to 45-50 mph and hit our car in an horrible rear end collision. Thanks god our car is manual and was in neutral so we didn't get hurt however the car after the impact traveled a block before stop , the damage was important in the back of the car a WV beetle i don't know and i hope is not going to be declared totaled.

    The police arrived and saw the conditions of the accident, they said it was her fault for failure to yield at a traffic light and producing an accident , they gave her a ticket. In the information form she wrote her insurance information. All the time she was saying i am sorry i am sorry i tough you were going through .

    After the accident my husband filed a claim with our insurance company and they started what is called a subrogation process in which they fix the car and later claim to her insurance company.

    However today my husband received a call from her insurance , interestingly it is another completely different insurance company compared with the information she put in the form. Apparently she also filed a claim. They said that she said it was raining so badly at the moment of the accident ( false, it was not raining at all , but after the collision a light very light drizzle started) and that it was not her fault because we stopped in yellow and you are not supposed to stop in yellow. Also that the conditions of the weather impede here to stop which is false.

    I am worry , it is obvious that this is not a good person ant that she is not interested in tell the truth to anyone in order to avoid the consequences

    Is it any way they can blame us for stop legally at a yellow before a red light? even with a ticket?
    why is the insurance different from what she wrote in the accident form ? Is it legal to lie at that form?
    What should we do? should we hire a lawyer for this accident?

    just sounds like she is trying to escape blame. Based on your rendition, I don't see how it is possible and unless she comes after you for something, I wouldn't worry about it. Your insurance company will deal with it.
