    Default Being Sued for HOA Dues for Foreclosed Condo in California

    My question involves a condominium located in the State of: California

    We're being sued for HOA dues for a condo that we previously owned and had since been foreclosed. The approximate amount the HOA want is $35,000 + fees. This includes an HOA special assessment of $16,500, and two years for monthly dues of about $500/month, and penalty fees.

    We have no way of paying that money.

    What is our recourse?

    If you haven't seen a bankruptcy attorney, you should by now. The HOA has every right to come after you, and the HOA itself can be pursued for negligience if it FAILLED to pursue owners, or former owners, who failed to pay dues, and special assessments.

    I had to pay a special assessment once because of the failure of many other owners to pay dues, and you can imagine what I would say if the HOA failed to pursue, and I wind up paying for others who can't pay.

    Your recourse is to file bankruptcy or make a deal to pay it, or get sued and have any assets you have executed against.
