    Default Can Anyone Dispute My Eligibility

    I'm on social security, I live with my brother and I want to move out. He says I have to live with him until his child support ends or he will call SS ever day until they get tired of him and kick me from disability. He is also saying he will not let any movers into the house and that I will move it on my own which is impossible. I feel like a hostage and its making me depressed. He's really abusive mentally and hes breaking my spirit I have to get out.

    What happens if he calls SS every day? Can someone get sick of him and kick me off so they don't have to deal with him? I don't mind going through the process again as long as I don't lose any payments during the process and as long as I don't have to keep doing them over and over.

    He won't get bored he will call 15 times a day for years. He makes myspace and facebook pages of his ex hes made like 30 of them that say she has STDs and is a swinger. This is something he might do to me also.

    What happens if he calls the SSA every day? He'll talk to somebody there about whatever they talk about until the call ends. We have no way of knowing what he plans to say or why you would find it worrying.

    Doesn't he ever leave the house? Movers can come while he's out.

    I'm trying to find out what happens if he lies to them and says I'm not disabled that I'm pretending. I keep reading all these stories on the internet of people saying they was kicked off or had to get a lawyer to be approved.

    I just need to know If someone makes a claim of fraud do they stop payment until a investigation is done? I'm worried if I move out and they decide to investigate me and pause payments I won't be able to pay rent or eat.

    I've been to government doctors in the past and I have plenty of mine and files of medical records so passing is not the problem. I just can't afford for payment to pause or stop.

    Your brother cannot make Social Security stop paying benefits to you. Your brother is not a decision maker for SSA and does not decide whether or not anyone meets the definition of being disabled.

    However, SSA cannot stop him from making false statements to the local office, to the teleservice center or to the OIG. SSA cannot stop him from calling 15 times a day or writing letters or making facebook pages. However, statements made by family members are never sufficient for Social Security to either pay or stop paying benefits on the basis of disability. Family members statements have to be supported by medical evidence and SSA only looks for medical evidence during an initial claim or during a continuing disability review.

    It is possible that statements he makes in his phone calls will be investigated by SSA. You may or may not be asked to explain what he claims. Or he may be told that he does not determine when SSA does a review nor does he have the decision making authority to determine that you are either disabled or not disabled. He may be aggravating. He doesn't have the power he is claiming.

    He pays child support for his daughter. It has nothing to do with me other than he says I can't move out until after his payments end in December.



    Thank you Janke, thats the answer I was looking for. Someone, told me an investigation stops payments until its over. I was concerned he could cause enough investigations to keep me from paying my bills.
