My question involves judgment recovery for the state of Arizona
We filed an Injunction Against Harassment against our neighbor in March of 2009. It has since expired. We renewed the IAH in March of this year, but is hasn't been served yet because the neighbor has been in & out of town. The neighbor has a felony trial scheduled for Dec. of this year and we plan to have him served with the IAH Order at that hearing. It's impossible to have him served at his house, his family members answer the door and tell the server he's not home.
On the IAH we filed in 2009, the day after he was served, the Defendant filed a motion for a hearing to contest our IAH. The judge granted the hearing request and it was scheduled for 2 weeks later. We attended the hearing, but the Defendant did not. The judge granted us $250.00 towards attorney fees citing that the Defendant was given notice of the hearing which he requested, but failed to appear.
I know $250.00 isn't a lot of money, but right now to us it is. Is there a way I can try to collect this money myself without going through a collection agency? I doubt a collection agency would be interested anyway since the amount is so low. Or would it be possible to file a lien against his house for this judgment?
