    Default Do You Need a Lawyer to File for Contempt of Court

    Good Morning!

    I posted yesterday and was told to contact DCS for help with my situation; however, from what I understand, they only handle back support.

    A brief overview of my situation. In 2005 I took my ex back to court through the Prosecutors Office, so now is fairly current in his support. However, he has made no attempt to comply with the other issues outlined in the divorce decree and I was told that the Prosecutors Office could not handle this. If I file a motion to have him held in contempt, will I need an attorney or will I be ok to do this on my own? I have gathered a lot of reciepts etc, but not sure what is good enough.

    I sincerely appreciate all your help and I am so sorry for re-posting in a new thread, but I was afraid I would be overlooked. I need to work very fast on this because he just inherited some money and he is a drinker and a gambler. Since his inheritance, he lost his job...perhaps on purpose, I am not sure. I have been a single mom even when we were married and it is about time he take some responsibility.

    If you're capable of figuring out how to draft, file, serve and argue your motion with the trial court, you can proceed without a lawyer. For most people, particularly those who haven't done it before, that's a tall order. If your ex- shows up in court with a lawyer, it will also be harder for you to prevail if you're not represented.
