    Default When Can a Civilian Employee of the Military Get Out of a Lease

    My question involves landlord-tenant law in the State of: Virginia

    My tenant informed me that he is leaving. He is going from a "Title 10" civilian position with the Marine Corp to a GS-14 position with the Army. His lease states "Tenants who are not military have the right to terminate this lease if transferred 50 miles or more from the premises by the employer stated on the Rental Application."

    The application lists his employer as "Marine Corp University". He is calling this a "transfer". I say he is simply changing jobs.

    Can he legally break his lease? A quick talk with a local attorney leads me to believe that he cannot.

    Note: I am trying to re-rent to assist him, but still want to know my rights.

    From what you have stated here, I favor the interpretation already given by your lawyer.
