    Default Employer Failed to Pay Into Unemployment

    I'm in California. My former employer has failed to pay in to the UI fund and also hasn't responed to EDD. I found out today that means that I probably won't get benefits. Lucky me. What do I do now???

    What did the EDD tell you to do?

    If you were an employee and they didn't report your wages and pay the appropriate tax, the state will go after them.

    Did they not report your wages at all, or did they report your wages and just not pay the tax? If the former, do you have pay stubs showing you worked there as an employee?

    EDD told me to wait! Employer didn't report or pay in. They also haven't responded to EDD yet. I've already sent in copies of check stubs to EDD.

    I agree that sucks. Unfortunately, that's all you can do right now.

    Well, I'm *still* waiting. I finally got the phone number of the auditor that is doing the "recomputation" and it turns out she sent me a letter asking for more information. She said she needs copies of check stubs -- which I sent back in MAY! So I went ahead and faxed them in AGAIN after speaking to another person after my landlord said pay up or move out by next Monday. That person said he would check first thing (6am) to see if the auditor had entered the wages and the check would be cut right then. I was very polite and very appreciative of everyone I spoke with (except for one minor slip when I said the auditor hadn't pulled her head out of her hiney). I guess the combination of politeness, eviction and tears made a difference. Now to borrow the rent $$$ until I get the check...

    I was in virtually the same situation that you are now (in Michigan). I had to go through the initial filing, request for additional information, an auditor and finally his supervisor. Total time on this end was 13 weeks from filing to first check. I'm glad that things are finally starting to come together for you. Keep the faith!
