    Default Forms Needed for Step Parent Adoption in Oklahoma

    My question involves adoption law for the State of: Oklahoma
    Does anyone know what forms or where to go to get forms for a step parent adoption in Oklahoma? Also do you have to change the name on the birth certificate?
    The bio dad has agreed to sign over his rights. The only 2 request he made is that the child be able to keep his last name and that he still be able to see him.
    The bio dad isn’t a horrible person. He loves his son. He just has issues that he can’t over come and would never be able to financial or mental be able to take care of my child to the degree that he should be taken care of. I haven’t seen child support in over a year. So it is in the best interest of our child that my husband has rights to him so that if something happens to me that my oldest son could stay with his younger brother and my husband could keep him. My husband has wanted to adopt him for a few years now (we have been married 5). We just finally talked bio dad into it. Just wanted to let y’all know this is not a decision that was made in hast or taken lightly.


    We don’t have enough money to actually go hire an attorney I checked into it and was told it would run around 3,000. Since the bio dad agrees. I think we could do all the work or try to but I have looked all over the net and can’t find the documentation I need to use to file. I have found steps to the process but that is it. Any help would be greatly appreciated! Thanks.

    I can't guarantee that you'll be able to find a set of free, standard forms. I suggest checking with the probate court, or checking an area law school library or the county law library for a practitioner's guide that covers Oklahoma adoption as such a guide will generally include sample forms and pleadings.

    I'm confused.

    Dad is willing to allow your husband to adopt the child, but still wants the child to have his last name AND wants to see the child?

    This does not sound right and the court will NOT order this.

    A stepparent adoption is an all-or-nothing kind of thing.... unless of course you're willing to allow visitation with ...the ex-Dad. I don't know why you'd do that.

    You make it sound like I am lying about something?? Nope I will try to reword it but it is like I said.
    I am trying to keep my son from being raised by his bio dad in case something were to happen to me. My son is bio dad's only child. So the name thing is important to him. He is in no real position to fight me if I could take him to court. So he is willing to go along with me. Bio dad is (right now) sober alcoholic. We approached the whole idea to bio dad and my son in He knows he is in no postion to raise a child and loves him enough to know that my husband is a better father figure. But he still wants to see his child. My son is 11. If I completely cut ties it would hurt my son. We have talked to my son about it. He wants to keep his bio dad's last name too. My husband and his brothers were adopted. 2 of them took the new last name and one kept his old.
    names are not important to me. I don't mind letting my son see his dad as long as bio dad is clean. What is important to me is that my husband has rights to my child and can have custody of him in case something happens to me. That both of my boys can stay together and that my mom or my husband can make decisions for him.

    Hmm what about just paying for the forms? I have found sights that have forms and I guess they help you fill them out like http://www.reliableadoption.com/howitworks.htm
    just didn't know if they wre legit??

    I think you're in for a world of hurt.

    I'm sorry - but there it is.

    By all means just pay for the forms to be filled out.

    I strongly recommend you speak with an attorney though.
