I made a formal compliant with the Human Resources department at my company. A senior level manager made a racist remark to me in front of other employees. The HR department said she admitted it and said she was just joking. They claim they had a talk with the person and then closed the case. They are refusing to provide me a copy of the compliant that I filed. They told me that they will not provide any documents without a Subpoena. Are they allowed to do this?

In Texas yes, they are allowed to do that.

The company is not legally required to provide you with these (or most any other) documents.

In this particular situation, the company's only legal obligation is to make the offending behaviour stop. If this person never makes a racist remark at work again, then the company has done its legal duty.

At this point, since the offending behaviour seems to have stopped, there's absolutely nothing more that you can do. It's over. (Or to paraphrase your HR department, the case is closed.) Move on.

And why should they? If you wanted a copy of your complaint, you should have made a copy before you submitted it.

Thanks cbg, a simple answer was all that was needed, so I appreciate it.


PattyPA - I made my complaint over a recorded line and they log your compliant in their system, so there never was a file for me to make a copy.

OP, you obviously aren't planning to let this issue go anytime soon.

Please be advised that if you keep bothering your employer about this, your employer may fire you. And when this happens, here's an accurate and simple answer to your next question:

"Yes, your termination was perfectly legal." And don't fret, I won't waste your precious time explaining why, it just is. Period.
