My question involves an injury that occurred in the state of: California
We were driving down a canyon road when a small compact car slowed down very suddenly in front of us and then stopped completely. We slowed down and stopped about two feet from the rear bumper of the car up ahead. We laid on the horn and the driver in the first car showed no reaction, was using no signals, and made no move to exit the roadway. There was a car coming in the opposite direction which prevented passing on the left. After being there for about 5 or 6 seconds we were rear ended by a F350 at 50mph. The impact from the rear-ending pushed us into the car in front of us.
We stopped safely to avoid colliding with the vehicle in front . I feel the 1st car's driver exhibited gross negligence by essentially parking the car in the middle of a two lane highway with a speed limit of 50mph, and then not reacting in any way when we blew the horn. I also feel that the driver to the rear was negligent by crashing into us at such a high speed. We had been there for several seconds and the horn was blaring. One of us was transported to the hospital by ambulance with severe whiplash.
Are we at fault?
