Photo Red Light Ticket

My question involves a traffic ticket from the state of: California

My husband just received a photo ticket for a red light violation in the mail. The vehicle is register in my husbands and my name but my son drives it. The picture is neither that of my husband or myself or my son.

On the back of the ticket there is an affidavit of non-liability, but it says ALL information must be filled out, (including the name of the driver) or it will be disregarded. Can he just say it wasn't him and not name the driver or will they truely disregard it?

To clear his name, does my husband have to appear in court to prove he wasn't the driver? Can/should he do a TBD, or ... can he send in the incomplete affidavite stating it wasn't him, along with a copy of his license, to the photo light people ?

ps. the ticket came in his name and the person in the picture is a woman. Can they do that, just send it to any name?

That would be the surest way of getting a dismissal.

He can... Personally, I would prefer to handle it in person in front of the judge on the appearance date noted on the citation.

If the citation says they will disregard it, then they will likely disregard it!

They didn't send it to any name... They sent it to the registered owner of the vehicle which is consistent with normal procedures under the circumstances.
